Article 1 – Purpose
These Terms and Conditions (hereinafter "T&C") govern all sales made on the marketplace accessible at aunomducoeur.market (hereinafter "the Site"). By placing an order, the buyer acknowledges having read and accepted these T&C without reservation.

Au Nom Du Coeur LLC operates the marketplace platform and facilitates transactions between independent sellers and buyers.
Article 3 – Third-Party Sellers
The products listed on the Site are offered by independent sellers (hereinafter "Sellers") who are solely responsible for the description, quality, conformity, and availability of their products. Each Seller is identified on their respective product pages and store pages. The marketplace acts solely as a technical intermediary connecting Sellers and buyers.
Article 4 – Products and Pricing
Products are described as accurately as possible based on information provided by Sellers. Photographs are for illustration purposes and do not constitute a contractual element. All prices are displayed in euros (EUR), inclusive of all taxes (TTC), excluding shipping costs, which are indicated prior to order confirmation. Sellers reserve the right to modify their prices at any time, although products will be invoiced at the price in effect at the time of order confirmation.
Article 5 – Orders
The order process is as follows:
- Select products and add them to the shopping cart.
- Review the cart and validate the order.
- Enter delivery information.
- Select the shipping method.
- Choose the payment method and complete payment.
- Receive order confirmation via email.
The sale is finalized upon confirmation of payment. Au Nom Du Coeur LLC reserves the right to cancel or refuse any order in the event of a dispute related to a previous order or suspected fraud.
Article 6 – Payment
Payments are processed securely via Stripe. Accepted payment methods include credit cards (Visa, MasterCard, American Express) and other methods available through Stripe. All transactions are encrypted using SSL/TLS technology. No banking information is stored on our servers.
Article 7 – Shipping
Shipping is handled by each Seller according to the terms specified on their product pages. Shipping costs and estimated delivery times are communicated before order confirmation. In the event of delay or non-delivery, the buyer should contact the Seller directly, or contact our customer service for assistance at contact@aunomducoeur.market.
Article 8 – Right of Withdrawal
In accordance with Articles L221-18 et seq. of the French Consumer Code, the buyer has a period of fourteen (14) calendar days from receipt of the product to exercise the right of withdrawal, without having to provide a reason. To exercise this right, the buyer must notify the Seller of their decision by sending a clear, unambiguous statement (e.g., by email). The product must be returned in its original condition and packaging within 14 days of notification. Return shipping costs are borne by the buyer unless otherwise specified by the Seller. Please refer to our Refund Policy for further details, including exclusions.
Article 9 – Legal Guarantees
All products sold on the Site benefit from the legal guarantee of conformity (Articles L217-4 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code). In the event of a defective or non-conforming product, the buyer may request repair, replacement, or a refund under the conditions provided by law.
Article 10 – Liability
As a marketplace operator, Au Nom Du Coeur LLC acts as a technical intermediary and cannot be held liable for the quality, conformity, or safety of products sold by Sellers. However, the platform commits to acting promptly when notified of any illegal content or product, in compliance with applicable regulations. Liability for delivery, product descriptions, and after-sales service lies with the respective Seller.
Article 11 – Intellectual Property
All content on the Site (texts, images, logos, graphics, icons, software) is the property of Au Nom Du Coeur LLC or its Sellers and is protected by intellectual property laws. Any reproduction, representation, modification, or distribution of all or part of the Site without prior written authorization is strictly prohibited.
Article 12 – Personal Data
Personal data collected during the ordering process is processed in accordance with our Privacy Policy, which the buyer is invited to read. Data is collected and processed for the purposes of order management, delivery, and customer communication. The buyer has the right to access, rectify, erase, and port their personal data, as well as the right to object and restrict processing, which may be exercised by contacting contact@aunomducoeur.market.
Article 13 – Applicable Law and Disputes
These T&C are governed by French law. In the event of a dispute, the parties shall endeavor to reach an amicable resolution. Failing that, the dispute shall be submitted to the competent courts in accordance with applicable law. In compliance with Articles L611-1 et seq. of the French Consumer Code, the buyer may also resort to conventional mediation or any alternative dispute resolution method.
Article 14 – Modifications
Au Nom Du Coeur LLC reserves the right to modify these T&C at any time. The applicable version is the one in effect on the Site at the time the order is placed. Users will be informed of any significant changes via the Site or by email.
